Terms of Service
The agreement governing your use of DivineCare Service.
1. Acceptance of terms
By accessing or using the DivineCare Service platform (the “Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.
2. The Service
DivineCare Service provides healthcare agencies with tools for patient and individual management, scheduling, medication tracking, document management, onboarding, and related care-coordination features, delivered as a hosted web application.
3. Accounts & eligibility
- You must provide accurate registration information and keep credentials confidential.
- You are responsible for all activity under your account.
- Accounts are for authorised staff of a subscribing agency; sharing credentials is prohibited.
- Notify us promptly of any suspected unauthorised access.
4. Acceptable use
You agree not to:
- Use the Service unlawfully or in violation of healthcare or privacy regulations.
- Attempt to gain unauthorised access to the Service or other customers' data.
- Reverse engineer, disrupt, or overload the Service or its infrastructure.
- Upload malware or content you lack the right to store.
5. Customer data & PHI
You retain all rights to the data you enter (“Customer Data”), including protected health information. You are the data controller; DivineCare Service processes Customer Data solely to provide the Service and per your instructions and the applicable data-processing agreement. Our handling of personal data is described in the Privacy Policy.
6. Availability & support
We aim for high availability and provide support per your subscription plan. Planned maintenance is scheduled to minimise disruption; specific service levels, where offered, are set out in your agreement.
7. Fees
Fees, billing frequency, and payment terms are defined in your order or subscription agreement. Unless stated otherwise, fees are non-refundable and exclusive of applicable taxes.
8. Intellectual property
The Service, including its software, design, and content (excluding Customer Data), is owned by DivineCare Service and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.
9. Disclaimers
The Service is provided “as is” without warranties of any kind to the maximum extent permitted by law. DivineCare Service is a software tool and does not provide medical advice; clinical decisions remain the responsibility of licensed professionals.
10. Limitation of liability
To the maximum extent permitted by law, DivineCare Service is not liable for indirect, incidental, or consequential damages. Our aggregate liability is limited to the fees paid for the Service in the twelve months preceding the claim, except where such limitation is prohibited by law.
11. Termination
Either party may terminate per the governing agreement. On termination, your right to use the Service ends and Customer Data is returned or deleted in accordance with the Privacy Policy and applicable retention obligations.
12. Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date and, where appropriate, advance notice. Continued use after changes take effect constitutes acceptance.
